This Privacy Policy (“Privacy Policy“) explains how Sooth Inc., a Delaware corporation (referred to as “Sooth,” “we,” “our,” “us,” and similar terms) collects information from users (each referred to as “you,” “users,” and similar terms), and how we use and share that information. We provide a variety of services through our website (https://sooth.fyi, the “Site” or the “App”) and any other software that we make available to you (collectively, the “Sooth Platform”)
By using the Sooth Platform, you agree to the terms of this Privacy Policy. Your use of the Sooth Platform is also subject to the Terms of Use posted at this link: https://sooth.fyi/terms-of-use. Capitalized terms used in this Privacy Policy are defined in the Terms of Use unless they are defined in this Privacy Policy.
Where this Privacy Policy Applies.
This Privacy Policy applies to all use of the Sooth Platform.Changes to this Privacy Policy.
We may make changes to this Privacy Policy from time-to-time. All changes will be effective when posted on the Sooth Platform, unless we specify a later date. If we make any material changes to this Privacy Policy, we will notify you through the Sooth Platform, by email, or other communication. We encourage you to read this Privacy Policy periodically to stay up-to-date about our privacy practices. As long as you use the Sooth Platform, you are agreeing to this Privacy Policy and any updates we make to it. If you do not agree to the updated Privacy Policy, you may not continue to use the Sooth Platform, and your only option will be to terminate your account.Children’s Online Privacy Protection Act (“COPPA”) Compliance.
- Information We Collect. Personal Information, as defined by COPPA, is underlined.
- Email. When you register an account, you must provide your email address directly or by using the Single Sign On feature provided by one of our service providers. If you do not wish to provide an email address directly or use the Single Sign On feature to create an account, then your only option will be to not create an account and not use the Sooth Platform.
- Username. Upon account registration, users are assigned a randomly generated unique Username. Users do not have control over the username they are assigned, however, users may modify or personalize their Username as long as it remains appropriate and unique.
- Usage Data. To provide the Sooth Platform to you, and to help us understand how you use the Sooth Platform and to help us improve the Sooth Platform, we automatically receive information about your use of the Sooth Platform and other Usage Data. “Usage Data” does not identify you by name and may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, city, information about how and when you use our App, device event information, hardware settings, and other technical information. Some Usage Data, such as IP address, may be considered personal information under certain state privacy laws even though it does not reveal your specific identity. To anonymize the Usage Data, we assign users a Persistent Identifier.
- User Generated Content. Our note-taking tools and other related productivity features allow users to create their own content. This is optional and is limited to text-based content.
- Grade Level. Users are asked to provide their Grade Level. This allows us to better understand our users so that we may improve our platform and services.
- Password. In the event a user does not take advantage of the Single Sign On feature when creating their account on Sooth, we will collect your password and store it in encrypted (hashed) form in order to maintain a safe and secure platform environment.
- We do not require users to disclose any more information than is reasonably necessary to take full advantage of all the benefits of the Sooth Platform.
- How We Collect Information, Including Personal Information As Defined By COPPA.
- We collect information on our users during account registration (which is required to access the Sooth Platform) and whenever the user chooses to directly provide the information such as any User Generated Content, while using the Sooth Platform.
- We also collect information on our users indirectly through the use of “cookies” and similar technologies to understand how you use the Sooth Platform and interact with it, to learn what content and features are popular, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. You should consult your web browser(s) to modify your cookie settings to meet your priorities. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of the Sooth Platform and your use of the Sooth Platform may be negatively affected.
- How We Use Information Collected, Including Personal Information As Defined By COPPA. We use the information we collect from all users to:
- Facilitate secure account creation and management;
- Communicate with users periodically, including for administrative and informational purposes;
- Personalize the Sooth Platform;
- Provide users with customer support;
- Provide support for the internal operations of the Sooth Platform;
- Protect our users and the Sooth Platform, by, for example, fraud monitoring and prevention;
- Enforce our terms, conditions and policies for business purposes, or to comply with legal and regulatory requirements;
- Obtain user feedback; and
- Analyze how users use the Sooth Platform.
- How We Share Your Information, Including Personal Information As Defined By COPPA.
- Legal Obligations. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
- Vital Interests. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
- Third Parties. We do not sell Personal Information, and we do not disclose Personal Information to third parties for their own independent commercial purposes. We work with a limited number of service providers — such as Single Sign-On and cloud hosting providers — who process Personal Information solely on our behalf, under contract, and solely to operate the Sooth Platform. These service providers are not permitted to use Personal Information for their own purposes or to collect information about our users independent of providing services to us. All Personal Information is collected for the purposes described in Section 3.3 of this Policy. We do not collect Personal Information for any other commercial purpose.
- COPPA Consent Mechanism. We do not ask users for their age or birthdate; because the Sooth Platform is used by students across all grade levels, we treat all users as though they may be under 13 and apply COPPA’s protections platform-wide. Consistent with FTC guidance, Sooth relies on schools and districts to obtain any necessary parental consent on our behalf under COPPA’s “school official” exception, in connection with the school’s use of the Sooth Platform for educational purposes. Schools and districts represent that they have authority to consent to the collection of student Personal Information under COPPA and applicable state law. Parents may contact their school or district, or us directly at contact@sooth.fyi, with questions about their child’s Personal Information.
Information Others Collect.
- Given the nature of the Sooth Platform, our users are routinely directed to third party sites whenever users click a search result on the Sooth Platform. When users click on any of these third party links, the applicable third party’s terms and policies apply, including the third party’s privacy and data gathering practices. We do not control any third party or their collection of your information. Please review the respective party’s privacy policy to understand their collection and use of your information.
- Other websites, mobile applications and services that you interact with may collect information from you after you leave their website, including information related to your use of the Sooth Platform. We do not control any third party or their collection of your information. Please review the respective party’s privacy policy to understand their collection and use of your information.
Student Data Privacy Agreements.
Sooth enters into standalone Student Data Privacy Agreements with our school and district customers, consistent with applicable state student data privacy laws. Sooth is a vendor member of the Student Data Privacy Consortium (SDPC) and supports the use of SDPC’s national data privacy agreement forms where applicable.Data Retention.
- We use reasonable efforts not to retain your personal information for any longer than necessary for the purposes set out in this Privacy Policy. Upon termination of our agreement with your school or district, or upon written request from your school or district, we will securely dispose of or transfer all student data, including Personal Information, typically within thirty (30) days, unless otherwise agreed. Data destruction is performed using industry-standard wiping and overwriting procedures to render data unusable and unrecoverable, including in backup archives. We provide written confirmation of data destruction upon request from a school or district. If immediate deletion is not possible (for example, because information is held in backup archives), we will securely isolate that information from further processing until deletion is possible. If you wish to request that we delete or modify your information, or that we deactivate your account consistent with the foregoing, you may contact us at contact@sooth.fyi.
- De-identified Data (see Section 3.1.3) is retained indefinitely, as it cannot be used to re-identify any individual user.
- Under COPPA, schools and parents have the right to review the Personal Information of their child under the age of 13 and may instruct us to delete it and/or discontinue its collection. Data Security.
We are committed to protecting the data of our users through administrative, technical, and physical safeguards, including: encryption of stored Personal Information (AES-256) and Personal Information in transit (TLS 1.2 or higher); role-based access controls and multi-factor authentication for all systems accessing sensitive data; annual security assessments; and mandatory, annual security and privacy training for all employees and subcontractors with data access. Even with these precautions, no security measures can be 100% secure, and we cannot guarantee the security of your data.Security Incident & Breach Notification.
In the event of a suspected or confirmed security breach involving student data, we will notify affected users and their school or district within 24 hours of detection, consistent with our contractual and regulatory obligations. Notifications will include, at minimum: our contact information; the types of Personal Information reasonably believed to have been affected; the suspected date and time of the incident; a description of the incident’s nature and scope; steps we have taken to respond; and expected next steps. We provide follow-up notifications as needed and a written incident report to affected schools or districts.
